Songbestie

Terms of Service

The short version

We wrote these Terms to be read, not skipped. This summary helps you find your way around. The full Terms below are what counts.

1. Welcome to Songbestie

1.1 Who we are. Songbestie is run by Mina Nasralla, an individual based in Berlin, Germany. His postal address is in the Legal notice at songbestie.com/legal-notice. In these Terms, "we", "us" and "our" mean Mina Nasralla as the operator of Songbestie. "You" means the person using Songbestie.

1.2 What these Terms are. These Terms are the agreement between you and us for using the Songbestie mobile apps, our website at songbestie.com, and anything else we offer that links to these Terms (together, "Songbestie" or "the service").

1.3 How you agree. You agree to these Terms when you tap the button that continues past the line saying you agree, or when you otherwise use Songbestie. If you don't agree, please don't use Songbestie.

1.4 What else is part of the agreement. These documents form part of these Terms:

Our Privacy Policy isn't a contract you sign, but it explains how we handle your personal data, and we encourage you to read it alongside these Terms.

1.5 Summaries and headings. The short version at the top and the headings throughout are there to help you find things. They don't change what the sections say.

2. Who can use Songbestie

2.1 Minimum age. You can use Songbestie if you're 13 or older. In some countries the law sets a higher minimum age for using an app like this on your own, or asks that a parent or guardian agrees first. If that's true where you live, that age or that permission applies to you too.

2.2 If you're under 18. If you're under 18, or under the age of majority where you live, please make sure a parent or guardian is okay with you using Songbestie under these Terms.

2.3 One person, one account. Each account belongs to one real person. Accounts for bands, brands or businesses aren't available in this version of Songbestie.

2.4 Other conditions. You can't use Songbestie if we've previously removed your account for breaking these Terms (unless we've told you that you may come back), or if the law where you are prevents you from using it. You also confirm that you aren't located in a country or region that is under a comprehensive U.S. government embargo, and that you aren't on a U.S. government list of restricted parties. (This last point is one the app stores ask every app to include.)

3. Your account

3.1 Signing in. You create an account and sign in with your Apple account or your Google account. We don't use passwords of our own. Apple and Google handle the sign-in itself, and their terms apply to that part (see section 8).

3.2 Your username. When you create your account, you choose a username. Your username is permanent: you can't change it later, so choose one you're happy to keep. When an account is deleted, its username is retired and won't be given to anyone else.

We may remove or replace a username, or ask you to choose a new one, if it breaks these Terms or our Community Guidelines, or if it infringes someone else's rights (for example, a registered trademark or another person's name used to pretend to be them). If we do, we'll tell you why (see section 12).

3.3 Your display name and photo. You can also add a display name, a profile photo and a short bio, and change them whenever you like. These are public. They have to follow the Community Guidelines. In particular, your photo must be one you're allowed to use.

3.4 Keep your account safe. You're responsible for what happens in your account, so keep your Apple or Google account and your phone secure. If you think someone else has got into your account, tell us straight away at support@songbestie.com.

3.5 Your account is yours alone. You can't sell, rent, lend, give away or transfer your account or your username, and you can't let anyone else use it.

3.6 Keep your details accurate. Don't give us false information about yourself in a way that misleads people, for example by pretending to be someone you're not.

4. What Songbestie does

4.1 The service. Songbestie is a place to share your music taste and find people who share it. Today, Songbestie lets you:

4.2 It will change. Songbestie is a living product. We'll add, improve and sometimes remove features. Section 17 explains how we handle changes.

4.3 No full songs, no downloads. Songbestie doesn't stream full songs or let you download music. Previews play only inside Songbestie, streamed from Apple.

5. How Twins, taste match and suggestions work

5.1 Twins and taste match. We compare the songs in your Top 10 with the songs in other people's Top 10 lists. Songs you both have, and how close their ranks are, give the taste match percentage. The people with the highest match become your Twins. A full match needs the same ten songs in the same order. Lists that aren't full can still match, but never 100%.

5.2 What it uses, and what it doesn't. Twins and the taste match use only the songs in Top 10 lists and their ranks. They don't use your messages, your Self notes, your birthday, or anything about who you are beyond your list.

5.3 Home and lists of people. Home shows posts from the last 60 days: first from people you follow, then from clubs you've joined, then from everyone else, newest first in each group. It leaves out people you've muted and posts you've marked as not for you. Home isn't ordered by taste. Lists of people, such as followers, following and friends, put the people whose taste is closest to yours first, and people search does the same after exact username matches.

5.4 Crossed paths. When two people become friends on Songbestie, we may compare their Stuck-on history to see whether they were stuck on the same song at the same time. If they were, both of them are told. Crossed paths only ever looks at two people who are already friends, and it only shows the overlap.

5.5 It's for fun, not a verdict. A taste match is an estimate based on two short lists. It isn't a statement about who you are or who you should be friends with, and it isn't used to make any decision with a legal or similarly serious effect on you.

6. Your content

6.1 What "your content" means. Your content is everything you add to Songbestie: your lists and their order, Descriptions, Self notes, posts, comments, messages, club names and photos, your profile details, your votes, and songs you add by hand.

6.2 You keep ownership. You own your content, as far as it's yours to own. These Terms don't take that away. Songs, album covers and artist names belong to their owners, of course. Choosing and ranking them is what makes your list yours.

6.3 The permission you give us. So that Songbestie can work, you give us a permission (a "licence") to use your content in the ways set out below. In plain words:

The licence covers hosting, storing, copying, formatting (for example resizing a photo or fitting text to a screen), showing and sending your content, as needed to run, protect and improve Songbestie. That includes showing your public content to people inside Songbestie, including people who use it without an account.

6.4 Who sees what. The licence works according to who your content is meant for:

Username, display name, photo, bio, Top 10, honourable mentions, Descriptions, Stuck-on songs and their history, posts, comments, club posts, how many likes a post has, album-club vote totals

Who can see it: Anyone using Songbestie, including people without an account

Your followers, who you follow, and your friends

Who can see it: Anyone, except people you've blocked

Who liked a post

Who can see it: The post's author

Your own album-club votes and guesses

Who can see it: Only you. Everyone else sees only the totals.

Your birthday (day and month)

Who can see it: Only you

One-to-one messages, private club messages and songs sent in them

Who can see it: Only the people in that conversation or private club

Self notes

Who can see it: Only you

Your saves and your Top 10 changes log

Who can see it: Only you

6.5 Self notes stay private. Your Self notes are for you. We store them so you can read them. We don't show them to anyone, we don't use them for Twins, taste match, suggestions or anything else, and our moderators don't read them unless the law requires it.

6.6 When the licence ends. The licence for a piece of content ends when you delete it, or when you delete your account. Some things take a little longer or stay for good reasons:

6.7 Your promises about your content. When you add content to Songbestie, you promise that:

You don't need to own the songs you rank. Naming a song and choosing it for your list is fine. Copying things that aren't yours is different: for example, posting the full lyrics of a song, or uploading a photo someone else took without their permission.

6.8 Feedback. If you send us ideas or suggestions about Songbestie, we may use them freely, without paying you or owing you anything. We're grateful for them all the same.

6.9 We don't have to keep everything. We aim to keep your content safe for as long as you keep your account, and Songbestie is designed as a place for memories you can come back to for years. Still, we can't promise that content will never be lost because of a technical failure. If something truly matters to you, keep your own copy too. You can download a copy of your data at any time (see the Privacy Policy).

7. Music on Songbestie

7.1 Where the music comes from. Song information, album covers and 30-second previews on Songbestie come from Apple, through the Apple Music catalogue and Apple's public iTunes Search service. They're provided by Apple to help people discover music, and they belong to the record labels, artists, songwriters, photographers and other rights holders.

7.2 How you may use previews and covers. Previews and covers on Songbestie are there so you can recognise songs and discover them. You may listen to previews and look at covers inside Songbestie. You may not download, record, rip, save or redistribute them, use them as background music or as entertainment in their own right, or use them to promote anything.

7.3 Listening to the full song. Each song from Apple's catalogue links to Apple Music, where you can listen to the full song under Apple's own terms. Apple Music may need a subscription.

7.4 Availability isn't guaranteed. Not every song exists in Apple's catalogue, and not every song is available in every country. New releases may appear in Songbestie a while after they come out. Apple may change or remove song information, previews or covers at any time, and we have to remove them when Apple asks. When that happens, the song may show without a cover or a preview, or it may disappear from Songbestie. Your list keeps its place where we can make that work, but we can't promise it.

7.5 Songs you add by hand. If a song isn't in Apple's catalogue, you can add its title and artist yourself. A song added by hand opens a YouTube search for its title and artist. We don't link to a specific video, and Songbestie doesn't play it. Please add songs honestly: no made-up entries meant to spam, mislead or offend.

7.6 No endorsement. Songbestie isn't made, sponsored or endorsed by Apple, YouTube, any record label or any artist. Apple and Apple Music are trademarks of Apple Inc., registered in the U.S. and other countries. Previews provided courtesy of iTunes.

7.7 Song identity. We group versions of a song (such as remasters and live versions) as one song, and we treat remixes as different songs, so that lists can be compared fairly. Our grouping may not always match yours. We'll fix errors when we can.

8. Other companies' services

8.1 Who else is involved. Songbestie works with other companies' services: Apple (Sign in with Apple, Apple Music, the App Store, push notifications on iPhone), Google (Google sign-in, Google Play, push notifications on Android), YouTube (when you open a search for a hand-added song) and the service providers named in our Privacy Policy.

8.2 Their terms apply to their parts. When you use those services, their own terms and privacy policies apply to what they do. For example:

You agree to follow the terms of any third-party service you use with Songbestie, including your mobile network's terms for data use.

8.3 We're not responsible for them. We don't control those services, and we aren't responsible for how they work, what they show, or what they do with your data. If you leave Songbestie to open Apple Music or YouTube, you're on their service.

9. What you agree not to do

We want Songbestie to stay a good place for everyone, so please don't do any of the following, or help or encourage anyone else to:

9.1 Break the law or hurt people.

9.2 Pretend or mislead.

9.3 Game the system.

9.4 Share links or try to get around the no-links rule. Songbestie doesn't allow web links in posts, comments, messages, names or anywhere else people type. Please don't try to sneak them in, for example by spelling them out.

9.5 Misuse the music.

9.6 Interfere with Songbestie.

9.7 Use Songbestie commercially without asking. Songbestie is for personal use. Don't use it to advertise, sell, run promotions or send commercial messages without our written permission.

9.8 Misuse our name. Don't use our name, logo or design in a way that suggests we're connected with, or endorse, you or anything else, without our written permission.

10. Community Guidelines

Our Community Guidelines are part of these Terms. They explain, in everyday language, what isn't okay on Songbestie: hateful names, harassment, threats, spam, impersonation, content that encourages self-harm, illegal content, and anything that puts minors at risk. They also explain what happens if the rules are broken. You can read them in the app under Settings → Help & legal → Community rules, and at songbestie.com/community.

11. Tools to keep you safe

11.1 Report. You can report an account, a post, a comment or a song added by hand in Songbestie. If someone bothers you in messages, report the person from their profile and choose Inappropriate messages. Reporting is private: we don't tell the person who reported them.

11.2 Block. You can block anyone. Once you block someone, neither of you can see the other's profile, posts, comments or lists, and you can't message each other. We don't notify the person you block. You can unblock them in Settings → Privacy & notifications → Blocked accounts.

11.3 Mute and other controls. You can mute a person, so their posts and Stuck-on songs leave your Home; mute a chat or a club; hide the comments on your own posts; decline friend requests and message requests; and leave any club.

11.4 In an emergency. Songbestie isn't an emergency service. If you or someone else is in danger, contact your local emergency services.

12. How we moderate

This section explains how we deal with content and behaviour that breaks the law, these Terms or the Community Guidelines.

12.1 How we find out.

12.2 Reporting illegal content. If you tell us that something on Songbestie is illegal, please include, so we can act quickly:

We'll confirm we've received your notice, and we'll let you know what we decided and how you can ask us to look again.

12.3 Automated tools. To keep Songbestie safe at our size, we use some automatic tools. We use them only for the narrow jobs described here:

Apart from the filters that stop text being posted, a person makes every decision to remove content or restrict an account.

12.4 Who decides. Reports are reviewed by us, or by moderators we appoint. They act carefully, objectively and in proportion to the problem. They take into account everyone's rights and interests, including freedom of expression.

12.5 What we may do. Depending on what happened and how serious it is, we may:

We usually begin with the lightest step that solves the problem. We may go straight to a stronger step for serious harm, such as threats, child safety issues, or illegal content.

12.6 We tell you why. If we restrict your content or your account, we'll tell you by e-mail, at the address linked to your account. We'll say what we did and for how long, the facts behind the decision, which rule or law it's based on, whether automated tools were involved, and how you can ask us to look again. We may hold back details where telling you would break the law or put someone at risk, or where the content is high-volume deceptive commercial spam.

12.7 If you report something. We'll let you know what we decided about your report, by e-mail at the address linked to your account.

12.8 Misuse of reporting. If someone often sends reports or complaints that are clearly unfounded, we may, after a warning, stop handling their reports for a while. If an account often posts clearly illegal content, we may, after a warning, suspend it for a while.

12.9 Private spaces. We don't read your messages, private club conversations or Self notes as a matter of routine. If someone reports a person for inappropriate messages, the last five messages that person sent them in their one-to-one chat are attached to the report so our moderators can review them. We may also review private content where the law requires it.

13. Asking us to look again: appeals and complaints

13.1 Our internal complaints process. If we removed or restricted your content or your account, or if we decided not to act on something you reported, you can ask us to look again. You can do this for at least six months after we told you about the decision.

13.2 How. Reply to our e-mail about the decision, or write to support@songbestie.com. Tell us why you think the decision was wrong. It's free.

13.3 What happens next. A person who wasn't involved in the original decision, where we have one available, reviews your complaint. We'll decide without undue delay and tell you the result and the reasons. If we got it wrong, we'll undo the decision as far as we can.

13.4 Other options. You can also take a dispute to the courts. If you live in the European Union and the out-of-court dispute settlement rules of the Digital Services Act apply to us, you may choose a dispute settlement body certified under those rules. You can find the list on the European Commission's website: https://digital-strategy.ec.europa.eu/en/policies/dsa-out-court-dispute-settlement. In the UK, you can also complain to us about anything covered by the Online Safety Act using the same route.

13.5 Other complaints. For any other complaint about Songbestie, write to support@songbestie.com. We'll reply as soon as we reasonably can.

14.1 Respecting rights. We respect the rights of artists, songwriters, labels, photographers and everyone else who creates things, and we expect you to do the same.

14.2 Telling us about infringement. If you believe something on Songbestie infringes your copyright or another right you hold, send a notice to support@songbestie.com. Please include:

14.3 If your content was removed. If we remove your content after a copyright notice and you think that was a mistake, you can send a counter-notice to the same address, or use the process in section 13. We'll tell you what a counter-notice needs.

14.4 Repeat infringement. We close the accounts of people who repeatedly infringe others' rights, in appropriate cases.

14.5 Music content from Apple. If your notice is about a cover or a preview provided by Apple, we'll pass it to Apple as Apple's terms require, and remove the material if Apple asks.

15. Your privacy

15.1 The Privacy Policy. Our Privacy Policy explains what personal data we collect, why, who can see it, how long we keep it, and your rights. Please read it.

15.2 Messages aren't end-to-end encrypted. Messages and private club conversations travel to and from our servers encrypted, and our hosting provider stores them encrypted. They aren't end-to-end encrypted, which means that, technically, we could access them. Our people only look at them in the situations described in section 12.9 and in the Privacy Policy.

15.3 What's public is public. Anything you make public on Songbestie can be seen, and copied by others, for example by taking a screenshot. Please think before you post.

16. Notifications and messages from us

16.1 Push notifications. If you allow notifications on your phone, Songbestie sends you notifications about activity that involves you, such as new friend requests, messages, and a new #1 from someone you follow. You can choose which kinds you get in Settings → Privacy & notifications → Notifications, and turn them off completely in your phone's settings.

16.2 Service messages. We may send you messages in Songbestie or by e-mail about your account and about Songbestie itself, for example about a moderation decision, a change to these Terms, or a security issue. These aren't optional while you have an account, because they concern your rights.

16.3 No marketing without asking. We won't send you marketing e-mails unless you've agreed to receive them.

17. Changes to Songbestie

17.1 We'll keep improving Songbestie. We may add, change or remove features, change how they look, or limit how much of something you can do (for example, how many songs fit in a list).

17.2 We'll be reasonable about it. If a change will significantly affect how you use Songbestie, or remove a feature you rely on, we'll tell you in Songbestie in advance when we can, and explain what's changing. We make changes for good reasons: for example, to improve Songbestie, to keep it safe and secure, to respond to user feedback, to follow the law or a store's rules, or because a partner such as Apple changes what it provides.

17.3 If you're in the EU or UK. If a change to the service negatively affects your access to it or use of it in more than a minor way, and the law gives you a right to end this agreement because of it, you can do so free of charge by deleting your account.

17.4 Test features. We may let some people try features before they're ready. Those features may be less reliable, may change, and may be removed.

17.5 Pausing or stopping Songbestie. We may pause Songbestie for maintenance or because of events we can't reasonably control. If we ever decide to close Songbestie completely, we'll give you at least 30 days' notice in Songbestie, so you have time to download your data.

18. Paid features

18.1 It's free today. Songbestie is free and has no ads.

18.2 If we offer paid extras. If we offer paid features in the future, such as a subscription, we'll describe what you get and the price before you buy. Any extra terms for paid features will be shown to you before you buy, and they'll become part of these Terms.

18.3 You'll pay through your app store. Purchases are made through the Apple App Store or Google Play. The store handles the payment, and its terms apply to it. That includes how you're charged, renewals, cancellations and refunds.

18.4 Subscriptions. A subscription renews automatically at the end of each period unless you cancel it before then. You can cancel at any time in your Apple or Google account's subscription settings. Deleting Songbestie or your Songbestie account doesn't cancel a store subscription by itself.

18.5 Refunds. Refunds are handled by Apple or Google under their policies. Nothing here limits any right to a refund or to withdraw from a purchase that the law gives you.

18.6 Price changes. If we change the price of a subscription, we'll tell you in advance, and the stores will ask for your agreement where their rules or the law require it.

19. Leaving Songbestie, and when we may end things

19.1 You can leave at any time. You can delete your account in Songbestie under Settings → Account → Delete my account. You can also ask us to delete it by writing to support@songbestie.com from the e-mail address linked to your account, if you no longer have the app (see songbestie.com/delete-account).

19.2 What happens when you delete your account. Your profile, lists, posts, comments, likes, saves and votes are deleted, and your username is retired for good. Messages you sent stay in the other people's chats, no longer linked to you. Some things stay for a limited time or in a form that no longer identifies you, as section 6.6 and the Privacy Policy explain. Deleting your account can't be undone.

19.3 When we may suspend or close your account. We may suspend or close your account, or stop providing all or part of Songbestie to you, if:

19.4 How. Unless there's a reason not to (for example, if telling you would break the law, put someone at risk, or help a person who is abusing Songbestie), we'll tell you before or when it happens, with our reasons and how to ask us to look again (see sections 12.6 and 13).

19.5 Inactive accounts. We don't delete accounts for being inactive.

19.6 What lasts after the end. Sections that are meant to continue after this agreement ends keep applying, including sections 6.6, 6.8, 14, 20, 21, 22, 23 and 26.

20. Things we can't promise

20.1 We work hard, but Songbestie isn't perfect. We provide Songbestie with reasonable care and skill. Like every app, it will sometimes have bugs, interruptions and mistakes.

20.2 What we don't promise. As far as the law allows, we don't promise that:

20.3 Your rights stay. Nothing in these Terms takes away rights you have by law that can't be excluded or limited by contract. If you live in the EU or the UK, for example, you keep your legal rights for digital services, including the right to have a service that doesn't conform to the contract brought into conformity.

21. Our responsibility to you

21.1 What we're responsible for. We're responsible for loss or damage you suffer that is a foreseeable result of us breaking these Terms or failing to use reasonable care and skill. Loss or damage is foreseeable if it's obvious that it would happen, or if both of us knew it might happen when you started using Songbestie.

21.2 What we never limit. We don't exclude or limit our liability where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud, for harm we cause intentionally or through gross negligence, and for anything else the law doesn't allow us to limit.

21.3 What we're not responsible for. As far as the law allows, we're not responsible for:

21.4 A limit for everyone else. If you aren't a consumer in the EU or the UK, our total liability to you for all claims about Songbestie is limited, as far as the law allows, to the greater of (a) what you paid us for Songbestie in the 12 months before the claim and (b) 100 euros. This limit doesn't apply to the things listed in 21.2.

22. If someone makes a claim because of what you did

If you use Songbestie in a way that breaks these Terms or the law, and someone makes a claim against us because of it, you agree to cover the reasonable costs, losses and damages that result, including reasonable legal fees, as far as the law where you live allows. We'll tell you about the claim promptly, and we'll let you take part in how it's handled where that's appropriate.

If you're a consumer in the EU or the UK, this section applies only as far as your local law permits.

23. Which law applies, and sorting out problems

23.1 Talk to us first. Most problems can be solved with a conversation. Before starting any formal dispute, please write to support@songbestie.com and tell us what's wrong. We'll try to sort it out with you within 30 days.

23.2 The law that applies. These Terms are governed by the law of Germany.

23.3 If you live in the EU, EEA or UK. If you're a consumer living in the European Union, the European Economic Area or the United Kingdom, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim about these Terms in the courts of your home country or of Germany. We can only bring a claim against you in the courts of your home country.

23.4 Everyone else. If you live anywhere else, disputes go to the courts of Berlin, Germany, unless the law where you live says you can use your local courts, in which case you can.

23.5 Small claims. Nothing here stops you from using a small-claims court or a consumer authority where you live.

24. Extra terms for the App Store and Google Play

24.1 If you got Songbestie from Apple's App Store. Apple asks every app with its own terms to include the following. These points apply between you and us:

a. This agreement is between you and Mina Nasralla only, not Apple. Mina Nasralla, not Apple, is solely responsible for Songbestie and its content.

b. Your licence. We grant you a non-transferable licence to use Songbestie on Apple-branded products that you own or control, as allowed by the Usage Rules in the Apple Media Services Terms and Conditions. Songbestie may also be used by other accounts linked to the purchaser through Family Sharing or volume purchasing, where those rules allow it.

c. Support. Mina Nasralla is solely responsible for any maintenance and support for Songbestie, as described in these Terms or as the law requires. Apple has no obligation at all to provide maintenance or support for Songbestie.

d. Warranty. Mina Nasralla is solely responsible for any product warranties, whether express or implied by law, to the extent they aren't effectively disclaimed. If Songbestie fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for Songbestie to you. To the fullest extent the law allows, Apple has no other warranty obligation for Songbestie. Any other claims, losses, liabilities, damages, costs or expenses caused by a failure to meet a warranty are Mina Nasralla's responsibility.

e. Product claims. Mina Nasralla, not Apple, is responsible for dealing with any claims by you or anyone else relating to Songbestie or your possession or use of it. That includes product liability claims, claims that Songbestie fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.

f. Intellectual property. If anyone claims that Songbestie, or your possession and use of it, infringes their intellectual property rights, Mina Nasralla, not Apple, is solely responsible for investigating, defending, settling and discharging that claim.

g. Legal compliance. You confirm that you aren't located in a country subject to a U.S. government embargo or designated by the U.S. government as a "terrorist supporting" country, and that you aren't on any U.S. government list of prohibited or restricted parties.

h. Who to contact. Questions, complaints and claims about Songbestie go to Mina Nasralla, at the postal address in the Legal notice (songbestie.com/legal-notice), or to support@songbestie.com.

i. Third-party terms. You must comply with any third-party terms that apply when you use Songbestie, such as your mobile data provider's terms.

j. Apple as third-party beneficiary. Apple and its subsidiaries are third-party beneficiaries of these Terms. Once you accept these Terms, Apple has the right (and is treated as having accepted the right) to enforce them against you as a third-party beneficiary.

If anything in this section conflicts with the rest of these Terms, this section wins for apps downloaded from the App Store. These Terms don't create usage rules that conflict with the Apple Media Services Terms and Conditions.

24.2 If you got Songbestie from Google Play. Google Play's Terms of Service and policies apply to your use of Google Play itself. Google isn't responsible for Songbestie or its content.

25. Changes to these Terms

25.1 Why we might change them. We may update these Terms, for example because Songbestie changes, because the law or a store's rules change, or to make them clearer.

25.2 How we'll tell you. If a change affects your rights or obligations in a meaningful way, we'll tell you in Songbestie at least 30 days before it takes effect, unless we have to make it sooner for legal or safety reasons. When the change takes effect, Songbestie will show you a screen with the updated Terms, and you'll be asked to agree before you continue. For small changes that don't affect your rights, such as fixing typos or making something clearer, we'll update the "Last updated" date at the top.

25.3 If you don't agree. If you don't want to accept updated Terms, you can delete your account before they take effect. The Terms you previously agreed to keep applying to you until then.

25.4 Earlier versions. You can ask us for earlier versions of these Terms at support@songbestie.com.

26.1 The whole agreement. These Terms, with the documents listed in section 1.4, are the whole agreement between you and us about Songbestie, and they replace any earlier agreement about it.

26.2 If part of these Terms doesn't work. If a court decides that part of these Terms can't be enforced, the rest still applies. The part that can't be enforced is replaced by an enforceable term that comes as close as possible to what was meant.

26.3 Not enforcing straight away. If we don't enforce part of these Terms straight away, we can still enforce it later.

26.4 Transferring this agreement. We may transfer our rights and obligations under these Terms to another company, for example as part of a merger, an acquisition or a reorganisation, as long as your rights under these Terms aren't reduced. We'll tell you if this happens. You may not transfer your rights or obligations under these Terms to anyone else.

26.5 Our relationship. Nothing in these Terms makes you and us partners, employees or agents of each other.

26.6 Other people's rights. Apple and its subsidiaries can enforce these Terms as section 24.1(j) explains. Otherwise, no one other than you and us has any right to enforce these Terms.

26.7 Events beyond our control. We aren't responsible for delays or failures caused by events we can't reasonably control, such as outages at our providers, natural disasters, war, or actions by authorities.

26.8 Language. These Terms are written in English. If we translate them and the versions differ, the English version applies, unless the law where you live requires otherwise.

26.9 Legal notices to you. We may send you legal notices in Songbestie or to the e-mail address linked to your account. If you signed in with Apple and chose to hide your e-mail address, our messages reach you through Apple's relay address.
